Article 1 Subject
The general terms and conditions of sale described below detail the rights and obligations of the company EIRL Eroan Boyer and its clients within the framework of the sale of services related to web performance through its trade name "Agence Web Performance".
Any service provided through Agence Web Performance implies the buyer's unreserved acceptance of these general terms and conditions of sale.
Article 2 Presentation of Services
The characteristics of the services offered for sale are presented in the "Services" section of our website. Photographs are not part of the contractual scope. Agence Web Performance cannot be held liable if errors are introduced. All texts and images presented on the website agencewebperformance.fr are reserved, worldwide, under copyright and intellectual property rights. Reproduction, even partial, is strictly prohibited.
Article 3 Validity period of sales offers
The execution of an ordered service will take place no later than 3 months after the quote is approved, otherwise the sale will be considered null and void.
Article 4 Prices of Services
Prices communicated in exchanges and on our commercial materials are indicated in euros excluding tax. For companies based in France and for individuals, the applicable 20% VAT will be added to quotes and invoices.
Agence Web Performance reserves the right to modify its prices at any time. Services ordered prior to a price increase will nevertheless be invoiced at the price in effect on the date the order was registered.
No discount will be granted for early payment.
Article 5 Order
The client validates their order by returning a signed quote. This constitutes proof of commitment with Agence Web Performance.
The data recorded by Agence Web Performance constitutes proof of the nature, content, and date of the order. The order is archived by Agence Web Performance under legal conditions and deadlines. The client can access this archive by contacting our services.
Article 6 Payment Terms
Payment for orders is made by bank transfer within 30 net days following the issuance of the invoice by Agence Web Performance.
Article 7 Right of withdrawal
The right of withdrawal applies to the purchase of online services within the legal framework when they have not yet been performed. Any cancellation of a scheduled service must be made at least 48 hours in advance, otherwise it will be considered performed.
Article 8 Late Payment (clause applicable to professionals)
In case of total or partial default in payment for services provided on the pre-established due dates with the user, the buyer must pay Web Performance Agency a late penalty equal to one and a half times the legal interest rate.
The legal interest rate used is the one in effect on the day of service delivery.
This penalty is calculated on the amount excluding taxes of the sum remaining due, and runs from the due date of the price without any prior notice being necessary.
In accordance with articles 441-6 c. com. and D. 441-5 c. com., any delay in payment automatically entails, in addition to late penalties, an obligation for the debtor to pay a flat fee of €40 for recovery costs.
Additional compensation may be claimed, upon presentation of supporting documents, when the recovery costs incurred are higher than the amount of the flat fee.
Article 9 Intellectual Property
Reproduction of any site created or redesigned by Agence Web Performance requires prior authorization and the purchase of an annual license for the GeneratePerf extension. In case of unauthorized reuse, Agence Web Performance reserves the right to claim from the Client the payment of the amount of the Premium licenses included in the initial service.
Article 10 Customer Relations – After-Sales Service
For any information, question, or complaint, the client can contact the Customer Relations department of Agence Web Performance via the contact form. Responses are provided within 24 to 48 hours (business days only).
Article 11 Personal Data
Within the framework of the "Informatique et Liberté" law, the learner has the right to access and rectify information stored in our databases. For more information on data processing on the agencewebperformance.fr website and in our internal tools, please consult our Privacy Policy page.
